
Motorola BACKUP is offered complementary (Msg&Data Rates May Apply) from Motorola. After starting your subscription you will receive SMS messages only when you send in a request for help or to cancel your subscription. For help you may send HELP BACKUP to 48361 and to cancel your subscription you may send in STOP BACKUP to 48361.
The Motorola BACKUP service is provided by Tarsin (Europe) Limited, a company based in the US which has been nominated by Motorola to store the information you wish to back up on its servers. Tarsin (Europe) Limited's servers reside in the US, and therefore the personal information you back up will be transferred to the US. Tarsin (Europe) Limited will have access to your information only for purposes of providing assistance to you in retrieving your backed up information.
THIS SOFTWARE IS PROVIDED "AS-IS" WITH NO WARRANTIES OF ANY KIND. Motorola DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
NEITHER Motorola NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, COMPENSATORY, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING IN ANY MANNER FROM USE OF THE Motorola BACKUP SOFTWARE, WHETHER UNDER CONTRACT, TORT, OR ANY OTHER CAUSE OF ACTION, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, INVASION OF PRIVACY/VIOLATION OF RIGHT TO PUBLICITY, OR LOST PROFITS, SAVINGS, REVENUES OR LOST BUSINESS. ALL SUCH DAMAGES ARE DISCLAIMED TO THE FULLEST EXTENT SUCH MAY BE DISCLAIMED BY LAW.
Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions may not apply to you. This agreement affects specific legal rights you may have, which may vary from state to state or from one jurisdiction to another.
- You agree to establish an account with Motorola BACKUP and keep that account for your own, personal, use;
- You agree not to access or attempt to access the information of other users without their permission;
- You agree not to access or attempt to access ("hack") the Motorola BACKUP site or Tarsin (Europe) Limited software in any way;
- You agree not to use the Motorola BACKUP site or software for bulk commercial solicitation ("spam") via email, SMS, MMS, or by any other method or message service;
- You agree to keep the list of contacts in your categories and mailing lists to a reasonable number, as determined by Tarsin (Europe) Limited;
- You agree that you will not use the Motorola BACKUP site for any purpose that is illegal under any applicable laws.
Violation of these terms may result in Tarsin (Europe) Limited removing your Motorola BACKUP privileges for a period of time or permanently, and you may be subject to a fine or other punishment by your local governmental authorities for illegal or prohibited use.
Tarsin (Europe) Limited, its website, and Motorola BACKUP are owned and operated by Tarsin (Europe) Limited. Tarsin (Europe) Limited agrees to let you use the Motorola BACKUP site to upload, store, and download your own personal information as managed by Motorola BACKUP if you agree to this Acceptable Use Policy. If you don´t agree, you can´t use Motorola BACKUP.
